. - ,
4
o The DMG letter to T. Hartley dated July 12, 1995 states, at page three, last paragraph,
"ln order for the Division to approve the (new Permitl aonlicxtion COM, Inc. must ...
complete the on the ground work required ... (including) removal of tailing from the
Hazel-A adit ... and repair of all liner defects and tears." (Emphasis added.)
As of this date, none of the underlined items has been accomplished, Nevertheless, a new
permit was issued on July 27, 1995. It is difficult to escape the impression that the behavior exhibited
by this operator has paid off. Misrepresentations, evasions, outright lies, simple lack of performance
- all have been rewarded by deferral of costs and issuance by the State of continued sanction as
operators of a "milling facility" which has no legal teed stock, hence no identifiable legitimate purpose.
Our community has tried for several years to find some means of accommodation to the needs
and realities of both regulators and industry. We have been patient. So far, that patience has been
rewarded by obfuscation, prevarication, and environmental insult on the part of the Operators, and by
hesitation, accommodation, and outright retreat on the part of the Regulators.
This pattern is unacceptable.
Given that yet another deadline has been breached, without discernable excuse, we hope that
the Board will finally see its way clear to taking some stern measures to insure that no violation of
permit requirements will occur next Spring. Our community stands ready to cooperate in every
possible way to this end, and intends to exert the utmost vigilance to assure timely response to any
impending problems; this applies especially to unpermitted discharge from the Hazel A. Staff support
to the same end will be gratefully received.
Sincerely yours,
Q / / ~ / / (Cc~r£'~
R. N. Mason, Chairman
