•
If the permittee and/or successor applicant wish to contest the Division's cost figures, then all issues
and disagreements regarding the Division's cost figures will need to be fully resolved and any adjusted
financial warranty amounts provided to and accepted by the Division prior to the November 12, 1997
deadline.
If the permittee and/or successor applicant wish to explore the possibility of utilizing any existing
D.O.E, financial warranties to satisfy the Division of Minerals and Geology's reclamation bond
requirements, it will be necessary for the permittee and/or the successor applicant to provide to the
Division no later than November 12, 1997 sufficient written verification from the D.O.E. that: 1) The
entire 9.9 acre area comprising the Division of Minerals and Geology Reclamation Permit is fully
covered by a valid D.O.E. lease; 2) The current D.O.E. lease holder is the same entity as the Division
of Minerals and Geology permittee (Telluride Mining Co, if the Permit Transfer is approved; Blake
Mining Co. if the permit transfer is not approved); 3) The D.O.E. financial warranty fully covers all
reclamation activities and associated costs required by the approved Division of Minerals and Geology
Reclamation Permit; and 4) The D.O.E. will accept full reclamation responsibility for completing all
reclamation work required by the State Reclamation Permit in the event the State Reclamation Permit
is revoked by the Division of Minerals and Geology. Each of these conditions is necessary since the
Division currently has no "memorandum of understanding" with the D.O.E. regarding financial warranty
coverage for the State of Colorado's statutory reclamation bond requirements.
In order to have all issues fully resolved by the extended deadline of November 12, 1997, you will
need to submit the increased financial warranty amount and other necessary information several days
prior to the deadlline to allow Division staff sufficient time to review your submittal for adequacy.
If you have any questions or if I can be of further assistance, please contact me at the Division's
Durango Field Office, 484 Turner Drive, Building F, Suite 101, Durango, CO 81301, telephone no.
970-247-5062, fax no. 970-247-5104.
Sincerely,
~~ /
Tom Gillis
Senior Environmental Protection Specialist
/tdg
Enclosure(s)
m248fwi 1.tdg
CERTIFIED MAIL No. P 435 605 962
Return Receipt Requested
cc: Dorothy Blake, Blake Mining Co.
CERTIFIED MAIL No. P 435 605 963
Return Receipt Requested
Ray Fitzgerald, Telluride Mining Co.
2
