<br />• <br />If the permittee and/or successor applicant wish to contest the Division's cost figures, then all issues <br />and disagreements regarding the Division's cost figures will need to be fully resolved and any adjusted <br />financial warranty amounts provided to and accepted by the Division prior to the November 12, 1997 <br />deadline. <br />If the permittee and/or successor applicant wish to explore the possibility of utilizing any existing <br />D.O.E, financial warranties to satisfy the Division of Minerals and Geology's reclamation bond <br />requirements, it will be necessary for the permittee and/or the successor applicant to provide to the <br />Division no later than November 12, 1997 sufficient written verification from the D.O.E. that: 1) The <br />entire 9.9 acre area comprising the Division of Minerals and Geology Reclamation Permit is fully <br />covered by a valid D.O.E. lease; 2) The current D.O.E. lease holder is the same entity as the Division <br />of Minerals and Geology permittee (Telluride Mining Co, if the Permit Transfer is approved; Blake <br />Mining Co. if the permit transfer is not approved); 3) The D.O.E. financial warranty fully covers all <br />reclamation activities and associated costs required by the approved Division of Minerals and Geology <br />Reclamation Permit; and 4) The D.O.E. will accept full reclamation responsibility for completing all <br />reclamation work required by the State Reclamation Permit in the event the State Reclamation Permit <br />is revoked by the Division of Minerals and Geology.
