(EFCI) is <br />requesting modification of submittal dates for Stipulation <br />Numbers 17 and 6 contained in its approved Colorado Coal Mining <br />and Reclamation Permit No. C-81-014. <br />EFCI requests that the submittal deadline for Stipulation <br />No. 17, currently due within 120 days of permit revision <br />approval, be changed such that the deadline is contingent on a <br />decision on Technical Revision No. 09: GEC Refuse Disposal Pit. <br />The technical revision application is currently under review by <br />the Division. <br />A portion of the drainage and sediment control designs for <br />the GEC pit impact the lower portion of the existing Magpie Creek <br />temporary diversion channel. Until the technical revision is <br />finalized and approved, EFCI cannot determine the appropriate <br />design for the upstream portion of the Magpie Channel referenced <br />in Stipulation No. 17. EFCI requests therefore that the <br />stipulation deadline be modified to coincide with the approval, <br />denial or withdrawal of Technical Revision No. 09. <br />EFCI also requests that the annual submittal date for <br />Stipulation No. 6, currently July 1, be revised to a submittal <br />date of August 1. This revised date is concurrent with the <br />annual submittal date for the Southfield's Annual Hydrology <br />Report. In this combined report, all required hydrologic <br />monitoring data can be compiled and discussed in one document. <br />
