(EFCI) is requesting modification of submittal dates for Stipulation Numbers 17 and 6 contained in its approved Colorado Coal Mining and Reclamation Permit No. C-81-014. EFCI requests that the submittal deadline for Stipulation No. 17, currently due within 120 days of permit revision approval, be changed such that the deadline is contingent on a decision on Technical Revision No. 09: GEC Refuse Disposal Pit. The technical revision application is currently under review by the Division. A portion of the drainage and sediment control designs for the GEC pit impact the lower portion of the existing Magpie Creek temporary diversion channel. Until the technical revision is finalized and approved, EFCI cannot determine the appropriate design for the upstream portion of the Magpie Channel referenced in Stipulation No. 17. EFCI requests therefore that the stipulation deadline be modified to coincide with the approval, denial or withdrawal of Technical Revision No. 09. EFCI also requests that the annual submittal date for Stipulation No. 6, currently July 1, be revised to a submittal date of August 1. This revised date is concurrent with the annual submittal date for the Southfield's Annual Hydrology Report. In this combined report, all required hydrologic monitoring data can be compiled and discussed in one document.
