Long Division Dnector In response to your correspondence dated December 9, 1996 I conducted an inspection of the Siloam Pit on December 27, 1996 and discovered that there does appear to be mining disturbances outside the 9.9 acre permit boundary. During the site inspection I estimated the total disturbance to be at least 16.5 acres. The Division has since requested the operator to complete and submit an accurate survey of all disturbances at the pit and to submit by January 22, 1997. Further, the Division has scheduled the operator as well as Mr. Ferd A. Mueller of Siloam Stone to appear before the Colorado Mine Land Reclamation Board at the February 26-27, 1997 meeting in Denver for pending enforcement action. We do not have an accurate survey of the actual acreages involved at this time. However, you reference preliminary survey work in your December corsespondence. I would appreciate a copy of the survey that was recently performed for Red Creek Ranch which can help to establish the size of disturbance and whether mining has in fact occurred outside the permit boundary. If available, please submit the survey at your earliest possible convenience. I will keep you appraised of the status of our pending enforcement actions against the parties involved.
