Long <br />Division Dnector <br />In response to your correspondence dated December 9, 1996 I conducted an inspection of the Siloam Pit <br />on December 27, 1996 and discovered that there does appear to be mining disturbances outside the 9.9 <br />acre permit boundary. During the site inspection I estimated the total disturbance to be at least 16.5 <br />acres. The Division has since requested the operator to complete and submit an accurate survey of all <br />disturbances at the pit and to submit by January 22, 1997. Further, the Division has scheduled the <br />operator as well as Mr. Ferd A. Mueller of Siloam Stone to appear before the Colorado Mine Land <br />Reclamation Board at the February 26-27, 1997 meeting in Denver for pending enforcement action. <br />We do not have an accurate survey of the actual acreages involved at this time. However, you reference <br />preliminary survey work in your December corsespondence. I would appreciate a copy of the survey that <br />was recently performed for Red Creek Ranch which can help to establish the size of disturbance and <br />whether mining has in fact occurred outside the permit boundary.
