Bonding <br />People in Attendance: Steve Layton, Dave Shelton, Fred Banta, <br />Ed Bischoff, Carol Russell, and later in the meeting, Dean Massey <br />Actions resulting from the lack of bond submittal on October 19, 1983 as <br />required by N.O.V. 83-21 and C.0. 83-001 were discussed. Two immediate <br />actions were as follows: <br />1. G.E.C. ceased mining on October 19. <br />2. A $750 per day penalty was being unposed by the Division. <br />Two possible future actions were discussed: <br />1. G.E.C. requesting a Board review of Cessation Order 83-001. <br />2. And/or the Division initiating bond forfeiture proceedings. <br />It was decided that the Board should be involved as soon as possible and <br />that Steve Layton could initiate this process by requesting review of the <br />Cessation Order. The Division emphasized that G.E.C.'s Board <br />presentation should be a plan to reduce the liability by either bond <br />submittal, transfer of obligations, or reclamation. <br />Dean Massey then participated in the discussion centered around <br />Dorchester's possible contributions to reduce G.E.C.'s outstanding <br />bonding liability. The possibilities included: 1) transfer of liability <br />for the tipple and haul road, and 2) filling of the Eastside Pit with <br />refuse. The Division's position for the two previous possibilities was <br />favorable because they reduce the bond liability. The Division suggests <br />that plans be submitted for the project areas. The plan for the tipple <br />area should address reclamation in the refuse area. Utilization of the <br />tipple area has been discouraged because it might increase bond liability <br />unless incorporated into Dorchester's permit area.
