If so, I would like you to add something that Cheryl and I discussed; <br />The GPS points surveyed by the Division during the inspection were obtained from the location of the <br />markers put in place by the o e~rator. The location of these markers depict an area of 3.8 acres. If these <br />markers were incorrectly placed, then the operator should have the site surveyed and the operator <br />should move the markers to depict the correct permit boundary. I will follow-up with letter, but wanted to get our <br />response to you as soon as possible so that you may complete the permit amendment process. <br />The Rules and Regulations are in the process of being revised to allow amendments to 110 permits. The <br />form that you are completing or have completed is the existing form that does not allow the option of an <br />amendment. We have, however, decided to allow you to submit an amendment application now rather <br />than later using our existing application form that does not have acheck-off box for amendments. (Please <br />address the completed application to our Ms. Erica Crosby so that we can make sure the administration <br />staff do not return it to you.) I believe that our Ms. Crosby indicated in her inspection report that you should <br />submit an amendment. We apologize for the confusion, but were trying give you a break on the permitting <br />process by allowing you to submit an amendment rather than having to submit a whole new application. <br />In reference to your other question. We agree with you that the area has been previously disturbed by <br />other mining operations. We also agree that as long as you do not reaffect those previously affected <br />areas, you are not responsible for its reclamation. You must, however, and it is your responsibility to <br />document, using existing documents in permit files we have, photographs that you take, accurate maps of <br />sufficient scale to fully describe the affected areas or other suitable means, so that it is clear what has been <br />previously affected. <br />4/26/2005 <br />
