Walther <br />3609 North COllnty Road 13 Executive Director <br />Loveland, CO 80538 Ronaid w. canany <br />' Acting Division Director <br />RE: Coulson Excavating Sand & Gravel Operations; Brownwood Pit (M-1979-n59) & Kirtright Pit <br />(M-1986-123) <br />Status Request for Substitute Water Supply Plan or Augmentation Plan <br />Dear Mr. Coulson, <br />The Division conducted inspections at the Brownwood Pit (Permit No. M-1979-059) & Kirtright•Pit <br />(Permit No. M-1986-123) on Mazch 27, 2002. Copies of the reports aze included for reference. <br />Each report noted [hat groundwater was exposed as a part of the active mining and reclamation operation. <br />The operator was required to submit a copy of an approved Substitute Supply Plan (SSP) or <br />Augmentation Plan issued by the Office of the State Engineer (OSE). The Division has no record that <br />this was submitted to the Division. <br />As you are awaze, the Division is required to hold a financial warranty to ensure the reclamation plan can <br />be achieved. If Coulson Excavating does not have the appropriate water rights in place, the reclamation <br />plan cannot be achieved and an alternate reclamation glan is required. Please inform the Division the <br />status of the Substitute Supply Plan or Augmentation Plan for the above noted sites. Without such plans, <br />the Division will be required to adjust the financial warranty to bacldill the grave] pits two feet above the <br />groundwater elevation. <br />The Division would appreciate a response, including copies of the SSP or Augmentation Plan no later <br />than January 31, 2003. If no response is received, the Division will adjust the financial warranty <br />accordingly. You will be notified of such increase.
