Long <br />D rvision Director <br />The Division received your January 9, 1994 letter regarding the <br />proposed changes to the planned work in the GEC West Pit. Your <br />letter mentioned four concerns. <br />Your letter discussed removal of the road leading into the West <br />Pit. I spoke with Jim McArdle of our office in regard to the <br />proposed East Pit work. He indicated that the road could be <br />removed or left in place without affecting the scope of work. If <br />you, as the land owner, wish to have the road remain in place, you <br />should contact Mr. McCardle. I do not believe removal or retention <br />of the road will affect the proposed drainage work in the west Pit. <br />Your letter also discussed a "drainage ditch 2" in the East Pit <br />plan which would potentially interfere with the original proposal <br />for final West Pit reclamation. Mr. McCardle informed me that this <br />ditch has been removed from the East Pit plan in an amendment <br />prepared after the pre-bid meeting. This should not affect the <br />drainage in the West Pit. <br />Your letter indicated you were not satisfied with my December 23, <br />1993 "proposed letter" to the Mined Land Reclamation Board. The <br />document which was copied to you was not a "proposed letter". It <br />was a letter which was sent to the Board at your request during our <br />December 21, 1993 meeting. My understanding at that meeting was <br />that you were interested in amending the "Agreement Concerning <br />Diversion of Water into Magpie Creek" if the Division would <br />acknowledge two Division errors to the Board.
