Office of Surface tlining (OSht) <br />Once a lease has been issued by BU4, the successful bidder (lessee) must <br />submit an underground mining pei~nit application to OSt4 in accordance <br />raith the requirements of 30 CFR 710.11 and 741.11. 05:4, with the concur- <br />rence of BLt•1 and USGS, recommends approval or disapproval of the lessee's <br />plans to the Assistant Secretary of Energy and tlinerals. The plan must <br />comply with the standards of 30 CFR 211 and 30 CFR 700 before it can be <br />recommended for approval. <br />Whenever a state has entered into a State-Federal Cooperative Agreement <br />with the Secretary of the Interior, pursuant to section 523(c) of S1•iCRA, <br />the state regulatory authority and OSM jointly review mining and permit <br />applications. Both agencies recommend approval or disapproval to the <br />Department of the Interior and the officials of the state authorized to <br />take final actions on the permit. <br />Assistant Secretary of Energy and t4inerals <br />The Assistant Secretary must approve a mining permit application and <br />significant modifications or amendments to it before a lessee can commence <br />mining operations. <br />® Consultation with Governor <br />The Governor shall be given not less than 30 days nor more than 60 days <br />in which to comment before publishing a notice of sale for any tract. <br />State of Colorado <br />A lessee must obtain permits and a license to mine coal from the state <br />of Colorado pursuant to the Colorado t4ined Land Reclamation .4ct of 1976. <br />Air quality, sold-waste disposal, and water quality must comply with <br />.rules and regulations administered by the Colorado Department of Health. <br />Reclamation of mined land must comply with regulations administered by <br />the Mined Land Reclamation Board of the Colorado Department of Natural <br />Resources. <br />La Plata County <br />The t•'emorandum of Understanding between La Plata County Board of County <br />Commissioners and the t4ontrose District Manager, BLM, contains the <br />following requirements. <br />A lessee must be in conformance with the following La Plata County <br />regulations and amendments thereto: <br /> <br />
