I am
requesting intervention by the appropriate State agencies to
investigate all permit violations by Basin Resources, Inc.
It is my belief that Basin is violating the emission permits
for the Golden Eagle and New Elk mines, as well as the
discharge permits. The greatly increased noise emitted by
the blowers must be in violation of the noise emissions
levels.
Basin Resources operates two mines, the Golden Eagle
and New Elk mine in Las Animas County, Colorado. Savage
Industries is the subcontractor hauling coal between the two
Basin mines.
In Marcia, i9~4, the residents residing in the vicinity of
the Basin mines presented Basin and Savage with a petition
requesting these parties to clean up the coal and coal dust
along Highway 12, reduce the noise pollution being emitted
from the Savage vehicles and to reduce the amount of coal
dust being discharged from the Savage trucks, which
contaminates vegetation, land and homes along State Highway
12.
Basin and/or Savage had failed to respond to complaints
made by the l.as Animas County Health Department, and the
County Planners Office prior to receiving the citizens
complaints. No action was taken until Basin and Savage were
advised they were going to be sued. Basin and Savage were
served with a lawsuit in May, 1994, for polluting the land
vegetation and water along State Highway 12.
