The Issuance of the <br />permit does not assure the applicant that no Injury will occur to another vested water right or preclude another <br />owner of a vested water right from seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless <br />approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump <br />Installation Contractors In accordance with Rule 18. <br />3) Approved pursuant to CRS 37-90-137(2) for the construction of a dewatering well to withdraw ground water <br />tributary to St. Vrain Creek which Is tributary to the South Platte River. <br />4) Aft ground water pumped must be discharged St. Vrain Creek without consumptive use or evaporative fosses. <br />5) This waif shall not be pumped unless the applicant can provide evidence to the division engineer that the <br />dewatering program will not result in Injury to other water rights. _ <br />6) A totalizing flow meter must be Installed on the well and maintained in good working order. Permanent records <br />of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the division <br />engineer upon request. <br />7) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court <br />case number(s) as appropriate. He shall take necessary means and precautions to preserve these markings. <br />8) Upon completion of the dewatering program, the applicant shall plug this well in accordance wkh the Water Well <br />Construction Rules. <br />9) Thls well, at any time, shall be located more than 600 feet from any existing production well. <br />10) The permitted location for this well is the location of the approximate centroid of the mine.
