MCC has since determined that this clay soil is suitable to use as <br />cover material over the geotextile clay liner to be installed in sediment pond MB-3 and will <br />temporarily stockpile the soil in the area of the lower stack tube pad that is currently under <br />construction and located within West Elk Mine's sediment and drainage control system. <br />Please contact me should you have questions. <br />Sincerely, <br />~~~- ~.~ <br />Kathleen G.
