Consideration of a possible notice of violation for failure <br />to comply with the corrective actions associated with Board Order MV-99-032, including <br />the payment of civil penalties (continued from the April 2000 Board Meeting, due to the <br />operator's inability to attend the hearing). <br />The Board considered the operator's request for continuance and denied the request. <br />The Board found a violation of failure to complete reclamation work or submit a <br />reclamation permit application by the specified due dates and failure to pay the $758.00 <br />civil penalty within 30 days of the signature date of the Board Order and failure to pay <br />the $33,000.00 suspended civil penalty after the failure to complete the required <br />corrective actions. <br />The Board directed the Division to consult with the Attorney General to consider <br />bringing suit to bring the operator in compliance with Board Order MV-99-032. <br />The Board previously assessed a civil penalty of $33,758.00.
