<br />July 1996 sampling effort. However, visual observation of Zigadenous venenousus was noted in <br />limited amounts on the northeast portion of the property. Zigadenous sp. is poisonous to cattle <br />and sheep. Due to the appazent limited abundance of Zigadenous sp., the Division does not <br />consider a weed problem to exist. <br />The applicant has removed all sediment ponds and ditches as approved by Technical Revision <br />No. 12. No erosional problems were observed during the bond release inspection. Water <br />monitoring was reduced by technical revisions no.'s 6 (TR-06) and 8 (TR-O8) and in December <br />of 1986 and May of 1988 respectively. Water monitoring was permanently suspended via <br />technical revision no. 10 (TR-10) in June of 1989. No surface or sub-surface water pollution due <br />to mining at this site had been identified prior to elimination of hydrologic monitoring. <br />SUMMARY <br />In summary, Kaiser Ventures, Inc. has completed the reclamation plan as currently approved <br />in the permit. The affected lands appear well on the way to successful reclamation to the <br />approved post-mining land-use of rangeland. The reclaimed area blends well into the <br />surrounding azea, even to the degree that the reclaimed azea is difficult to discern from the <br />undistwbed azea. The reclamation appears to be capable of supporting managed grazing. <br />Revegetation success criteria have been achieved to the extent necessary to control erosion at <br />the site. There is no further reclamation work remaining or contemplated at this site. No issues <br />or problems were identified as a result of the bond release inspection. Based on the <br />observations and findings as detailed above, the Division proposes to approve Kaiser Ventures, <br />Inc.'s request for a Phase II bond release for the CCMC No. 1. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published twice <br />in the Huerfano World for two weeks as soon as possible. Requests for public hearing must be <br />submitted to the Division in writing within thirty days of the first publication of the public notice. <br />If no hearing is requested the Division's decision will become final. <br />6 <br />
