s <br />Table 2-2 <br />Design Criteria <br />Topic Design Criteria for the Proposed Action <br /> When no longer needed for its intended use each drilled hole or borehole, wells, or <br /> other exposed underground opening shall be capped, sealed, backfilled, or otherwise <br /> properly managed, as required by the Division and consistent with 30 CFR 75.1711. <br /> Permanent closure measures shall be designed to prevent access to the mine workings <br /> by people, livestock, fish and wildlife, machinery and to keep acid or other toxic <br /> drainage from entering ground or surface waters. <br /> Exploration holes, drill holes or boreholes, wells or other exposed underground <br /> openings not completed to aquifers shall be sealed by replacing cuttings or other <br /> suitable media in the hole and placing a suitable plug 10 feet below the ground <br /> surface to support a cement plug or other media to within 3 feet of the ground surface. <br /> The hole will be marked. <br /> A surface plug shall be placed in accordance with 4.07.3(1) and the hole shall be <br /> marked. <br />*Federal Coal Lease Stipulation <br />`Canada Lynx Conservation Assessment and Strategy <br />Developments Associated with Project Proposal <br />Constmcting an estimated 0.7 miles of road on <br />private land and drilling and casing of up to 19 <br />MDWs at up to 17 sites on private land. <br />The effects of these activities are considered in <br />the effects analyses in Chapter 3. Without the <br />development on the FS, it is unlikely that these <br />developments would occur. <br />Other Permits/Plans Required or May <br />Be Required <br />NPDES Permit; <br />• SPCC Permit; <br />404 Permit-Proposed crossing of <br />jurisdictional drainages to follow the <br />permit conditions identified by the Army <br />Corps of Engineers in the 404 permit; <br />• Special Use Authorization issued by the <br />Forest Service (required); <br />• Road Use Permit issued by the Forest <br />Service (required). MCC has an existing <br />road use permit, however additional <br />mileage may need to be added and <br />performance bond may need adjustment; <br />Approved Pesticide Use and Weed <br />Control Plan; and <br />Alternatives Considered but <br />Eliminated from Detailed Study <br />Federal agencies are required by NEPA to <br />rigorously explore and objectively evaluate all <br />reasonable alternatives and to briefly discuss <br />the reasons for eliminating any alternatives that <br />were not developed in detail (40 CFR 1502.14). <br />Public comments received in response to the <br />Proposed Action provided suggestions for <br />alternative methods for achieving the purpose <br />and need. Some of these alternatives may have <br />been outside the scope of compliance with <br />Mine Safety and Health Administration <br />requirements for methane gas management, <br />duplicative of the alternatives considered in <br />detail, or determined to be components that <br />would cause unnecessary environmental harm. <br />Therefore, a number of alternatives were <br />considered, but dismissed from detailed <br />consideration for reasons summarized below. <br />Flaring of Methane Gas <br />Flaring of methane gas may cause mine <br />explosions due to fluctuations in the levels of <br />methane.
