Long <br />D rvaion Dlre[I Or <br />I called Larry to request the information he has obtained from Gunnison County <br />and the Water Commissioner from Division IV. He said he would send the <br />information in the next couple days. <br />He said that the water in Lone Pine Gulch is the adjudication right. The <br />final collection point is G-26 or CR-12, the point that MCC has monitored in <br />the past. He said Ralph Taylor began the adjudication process but was not <br />completed until 1971 when someone else finished up the paper work. <br />He mentioned that the law does not provide any qualifications. I said the <br />first question we need to answer is whether the damage to the spring was <br />caused by subsidence. He asked me if it was. I said I didn't know. I need <br />to determine the location of the spring and then talk again with <br />Jim Pendleton, I told him we have a number of maps that show the spring in <br />different locations. I said regardless of whether the spring is adjudicated, <br />MCC will monitor the spring. He said they have not built the road so how <br />could they be monitoring? I said I talked to MCC, and they felt they didn't <br />need a road because they would use the four-wheelers. Larry said in his <br />opinion that the noise from the four-wheelers causes more stress to the deer <br />and elk then an automobile. He said MCC would need an easement to run the <br />four-wheelers on the ranch and he would not give it to them based on the <br />reason stated above. <br />CEJ/amm/8705F <br />
