Any such assertion by the Mine or anyone else
is simply untrue. If you will look at the map you will see that
underground operations are within 200 feet of my house not 700 and that
the assertion that the operations are 700 feet distant from the house are
simply untrue. OF COURSE THIS LITTLE CORRECTION CERTAINLY HAS A MAJOR
IMPACT UPON THE TRUTH OF THE MATTER REGARDING THE ANGLE OF DRAW AND THE
IMPACTED SURFACE AREA.
Any claim by the Mine that they had no notice of my water well is
another outright falsehood. Only a blind man could fail to see the
windmill tower located only yards from the air shaft. You are also
directed to my letter of April 2, 1991, to Robin Forte (copy enclosed).
Please note my inquiry about damage to my water well in the last
paragraph.
Enclosed please find a copy of Basin Resources, Inc.'s Responses to
our Request for Admissions. I find it somewhat surprising that they deny
that they were to survey, inspect and record the condition of the
property. (Admission Request and Response No. 2).
Admissions Request and Response Nos. 6 and 7 deal directly with our
water well.
