RE: South Chieftan Clay Pit--Permit No. 78-13 and South Chieftan Clay
Pit--Permit No. 81-148
Dear Mr. Leidich:
As you know, this site was originally pe nder the Limited Impact
Operation format back in 1978. At the time of approval, the financial
warranty was set at $2,500, which was posted via bond No. 491E6761 by The
Travelers Indemnity Company.
Recently, Robinson's Regular permit application (No. 81-148)
was approved by the Mined Land Reclamation Board with financial warranty
set at $99,000. On N 983, the $99,000 financial warranty was
posted via bond No. 564F883-5 by The Travelers Indemnity Company.
Due to the submittal of the $99,000 financial warranty, the Division
releases the $2,500 financial warranty (bond No. 491E6761--The Travelers
Indemnity Company) for permit No. 78-13. Therefore, permit N
becomes null and void with all land disturbance and reclamation
responsibilities falling under permit No. 81-148.
Under normal circum the Division would enclose the released
financial warranty back to the operator. Unfortunately, the Division has
been unable to locate bond No. 491E6761 for $2,500. By copy of this
letter to the company, the Division hereby releases The Travelers
Indemnity Company of responsibility for permit No. 79-13 via bond No.
491E6761 for $2,500.
