unresolved enforcement actions. All penalties have been paid. The following are those <br />enforcement actions: <br />• NOV C-93-021 - Failure to maintain records at or near the mine site. <br />• NOV C-93-022 - Failure to design, permit and maintain various ditches and culverts <br />along roads and facilities' azeas. <br />• NOV C-93-029 - Failure to have anon-clogging dewatering device on a sediment <br />pond. <br />SECTION II -REVISIONS TO THE PERMIT <br />Since the issuance of the renewal the following revisions have been made to the permit: <br />Minor Revision Summary <br />• Minor Revision, MR-14, to revise minor designs with the sediment control plan, <br />approved June 9, 1993. This revision addressed minor hydrology concerns that were <br />revealed during the March 31 inspection and was part of the abatement ofNOV C-93-022 <br />• Minor Revision MR-15, approved November 3, 1993. This revision allowed the <br />construction of a temporary ditch to de-water the 720 pit prior to backfilling and grading. <br />• Minor Revision MR-16, approved November 16, 1993. This revision allowed the use of <br />ponds A, B and C to be used as treatment ponds for 720 pit water discharge. <br />Technical Revision Summary <br />• Technical Revision TR-10, approved October 29, 1993. This revision changed the <br />maximum backfilled slope in the Pit 1 area from 3.5 to 1 (horizontal: vertical) to a slope of <br />3 to 1 slope. <br />• Technical Revision TR-11, approved October 22, 1993. The revision resolved water <br />quality issues related to the storage, treatment and discharge of 720 Pit water through <br />ponds A, B and C. <br />SECTION III -STATUS OF STIPULATIONS <br />The following is a list of stipulations that are still applicable to the existing permit and were <br />incorporated in the renewal approved last year. <br />STIPULATION NO. 13 (listed as No. 1 during second permit term renewal) <br />KERB COAL IS REQUIItED TO CONSTRUCT ALL DITCHES USING THE DESIGN <br />GRADES RATHER THAN THE GRADES SHOWN ON MAP 16A.
