Walther <br />Ezecmive Dvecbr <br />M¢hael B. Long <br />Division Director <br />This letter serves as a follow up to our on site meeting at the Raton Creek Mine on July 22, 1999. As <br />we discussed at our site meeting, the un-topsoiled slope overlying the portal area exhibits considerable <br />rilling. This portion of the reclaimed azea is dominated by Cicer Milkvetch. EFMC's 1998 vegetation <br />study indicated that vegetative cover was not deficient at the peak of the growing season, but this <br />location lacked diversity. The un-topsoiled slope is heavily dominated by only one species. Cicer <br />Milkvetch is deciduous, which provides very minimal cover during the Fall, Winter and Spring months. <br />The Division recognizes that the un-topsoiled area at the north backfilled slope of the disturbed area is <br />not establishing a "diverse, effective and permanent vegetative cover" that supports the post-mining land <br />use (Rule 4.1 S.1(1)). During the July 22, 1999 inspection, you and [discussed potential treatments for <br />this slope. Treatment of this slope would need to be in accordance with Rule 4.15.7(5), or the <br />reclamation liability time period would be re-initiated on the affected area. The majority of the mine <br />site was seeded in 1995. <br />EFMC needs to submit a plan for treatment of the slope as a revision to the permit. [n order for EFMC <br />to implement a treatment plan for this slope, and maximize moisture the site receives in the winter, work <br />should be conducted during the fall of 1999. Please inform the Division of EFMC's plan for the <br />referenced portion of the reclaimed mine site. <br />To reiterate information requested in the Division's letter dated May 5, 1999, during my review of <br />EFMC's 1998 Annual Reclamation Report: <br />Please provide, on an accurate map, of the locations of the 1998 sample transects. This map <br />should also define where topsoiled versus non-topsoiled areas are. None of the previous annual <br />reclamation report maps make this definition clear. <br />2. Please indicate on the map that seeding was conducted in 1995and in what month seeding <br />occurred.
