Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to APPROVE, without conditions, <br />Hayden Gulch Terminal, Inc.'s application for permit renewal RN-02. <br />This decision is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. <br />If no request for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. The permit application, all <br />supporting documentation, and any stipulations or conditions will become a binding part of the <br />permit. <br />Stipulations to Permit <br />STIPULATION 6-O <br />THE APPLICANT SHALL SUBMIT TO THE DIVISION THE FOLLOWING INFORMATION AS SOON AS <br />IT BECOMES AVAILABLE: PROOF OF RESOLUTION OF BOND FORFEITURE AND VIOLATIONS <br />(050265, 050320, 052522, AND 05290$) ASSOCIATED WITH KENTUCKY PERMIT 8980140. <br />This stipulation was complied with on 14 May 2003 and has been terminated. A check <br />with both the OSM and the State of Kentucky Division of Surface Mining verifies that a <br />settlement in the above referenced bond forfeiture and violations has been reached. A <br />check of the Applicant Violator System (AVS) indicates that a flag for Kentucky permit <br />8980140 has been removed and a recommendation of ISSUE was given. <br />History Of the Loadout's Permit <br />The Loadout originally was part of the Hayden Gulch Mine, located approximately seven <br />miles to the south. The Loadout currently is in temporary cessation. The history of the <br />Loadout's permit is listed below. <br />Previous permit (C-80-003) <br />- Construction of Loadout Begins March 1978 <br />- HG Mine, the Loadout's then sister Operation, August 1978 <br />begins Operations <br />- HG Coal Company submits application for 16 December 1980 <br />reclamation permit for HG Mine and <br />Loadout <br />- Division Issues Permit C-80-003 for HG Mine 4 January 1981 <br />and Loadout <br />
