The operator, <br />Western Slope Carbon, Inc., failed to meet regulatory requirements <br />for an extended period of time. This failure to comply resulted in <br />revocation of the mining permit and forfeiture of the reclamation <br />performance bond being held by the Division. <br />One of the remaining reclamation tasks at the Hawk's Nest Mine <br />involves removing the coal material located at the Silo Facility <br />Area. Recent samples of coal taken by DMG and Terror Creek <br />indicate the coal is of suitable quality. Terror Creek Coal Co. <br />has expressed an interest in the coal material at the silo area. <br />The removal of the coal will enhance reclamation at the Hawk's Nest <br />Mine. <br />The Division approves removal of the coal material by Terror Creek <br />Coal Company for reclamation purposes. Attached are two copies of <br />a draft agreement outlining the responsibilities of DMG and Terror <br />Creek Coal Company. Please review the enclosed agreements. If <br />they are acceptable, sign and return them to the Division for our <br />signatures.
