A more precise legal description can be fournl on page 2.03-15 of the Permit Application <br />Package (PAP). There is no change in the present legal description of the PAP as a result of the <br />Application. <br />2. Proposed Decision <br />The Division proposes to approve an application forrenewal (Permit Renewal Number 4) of a <br />valid, existing permit (GI981-019} to conduct.surface mining and reclamation activities in <br />Colorado. <br />This Decision is based on a fmding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act; CR.S. <br />34-33-101 et seq., and the Rules promulgated pursuant to the Act. Public notice of this proposed <br />Decision will be published for two consecutive weeks in the Craig Daily Press. If no request for <br />a formal heazing is made within thirty (30) days. of the first publication of the public notice of this: <br />proposed Decision; then this Decision becomes fmaI. Acceptable surety by the Applicant is on <br />file with the Division. The Application and all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />Na coal.mining operations maybe conducted on any Federal surface or coal until the Secretary of <br />the Interior has approved the:proposed mining plan_ <br />3. Summary <br />3.1 History ofthe Review Process <br />3.1.1 Initiation and Progression of the Renewal <br />By letter of IIecember I4, 200I, the Bivision notified Colowyo of the need to renew permit (C- <br />1981-019) for the Mine. By letter of April 9, 2002, Colowyo responded by submittal of an <br />Application Form, Renewal of a Valid, Existing Permit to Conduct Mining in Colorado, with <br />supporting information (received at the Division on April 11, 2002). Colowyo notified the public <br />of irrtent to renevr the Permit (see para 3.12 followurg)_ <br />The Division advised Coiowyo by letter of April 12, 2002 that the Application was found . <br />incomplete. Colowyo revised (April 15, 2002) the public notice associated with the Application, <br />and the Division notified Colowyo, by letter of Apri122, 2002, that their Application was <br />complete for the purposes of filing as of Apri122, 2002. The Division notified the various public <br />agencies of the Application (see pazagraph 3.1.2 following) by letters of the same date. <br />A revision to the Application was received on May 31, 2002 in response to a verbal request of <br />the Division. The Division requested additional information from Colowyo by letter of June 17, <br />2002. An adequate response was received on July 8, 2002. A second adequacy letter of August 7, <br />October 21, 2002 <br />
