Coal Mine Waste -Rule 4.11 <br />No water is used in the coal processing operation, except for dust suppression, and no coal <br />processing waste is produced. <br />Non-coal waste is placed in the backfill of pits in a manner consistent with the requirements of <br />Rule 4.11.4. <br />X. Slides and Damage -Rule 4.12 <br />The.Permit is found to be in compliance with Rule 4.12_ Because of themining technique used, <br />natural barriers aze not necessary. Slides have occurred within the Permit boundary; however, <br />.none have had an adverse effect on public property, health; safety, or the envirorunent. Slides <br />have. been reclaimed as appropriate. A breach of a diversion ditch resulted in a mud and debris <br />flow on Highway I3 and private property. See Notice Of Violation (NOV} C-96-005, page 4, <br />Exhibit 2 or the Pemut. <br />XI. Contemporaneous Reclamation -Rule 4.13 <br />The Permit is found to be in compliance' with Rule 4.13_ Reclamation was found io occur as <br />contemporaneously as piadicablewith mining operations_ <br />XII. Backfilling and Grading -Rule 4.14 <br />The Permit was found to be incompliance with Rule 4.I4_ <br />A. Operations and Reclamation Plans <br />Colowyo's muting operations plan is €ound itx Seetiort 2f}5.3 o€the Permit_ Ie4ap-23 contains the <br />mine plan for Colowyo. Section 2.05.4 of the Permit contains the reclamation plan;.and Section <br />4.I4 contains the performance standazds for backfilling and grading. <br />Plans for dealing with and mortitorirtgocid-and-tazic fortning overburden. are described on pages <br />2.fl4.6-9 and 2:05-57 of the Permit and in Section B, Item III of this document.
