Findings of the <br />Colorado Division of Minerals and Geology <br />for the <br />COLOWYO COAL MINE <br />EXPLANATION OF FINDINGS <br />Pursuant to Rule 2.07.6(2) of the Regulations of the Colorado Mined Land Reclamation Board <br />for Coal Mining, and the approved state program, the Division of Minerals and Geology or the <br />Boazd must make specific written findings prior to issuance of a pernut,. permit renewal or permit <br />revision. These fmdings aze based on information made available to the Division that <br />demonstrates that the Applicant will be able to operate incompliance with the Colorado Surface <br />Coal Mining Reclamation Act and: the Regulations promulgated pursuant to the Act_ The fmdings <br />in the following sections required by Rule Z.0?."6(2) are Iisted in accordance with that Rule. The <br />findings and specific approvals required pursuant to Rule 2.07.6(2}(m) aze listed in accordance <br />with Rule 4 and aze organized under subject or discipline subtitles. <br />This findings document is updated upon permit renewal,.which occurs every five years for the <br />Colowyb Coal Mine (as for most other. coal minesin, Colorado). This findings documents the <br />reevaluation and update'of previous findings as necessary to reflect changes which have occurrefl . . <br />during the past pemut term or are permitted to occur in the ensuing 5-yeaz term. Any stipulations <br />from the original permit and findings document or subsequent revisions that have been totally <br />resolved,-ttrthe satisfaction a€ the Iivision, have been removed from tkis document_ <br />SECTION A -Findings Required by Rule 2.07.6(2) <br />I. Accuracy and Completeness. The Application is accurate and complete, and in compliance <br />with all requirements of the Act and these rules. <br />II. Feasibility. Based on information contained isthe Application and other information available <br />to the Division, the Division fords that surface coal mining and reclamation can be feasibly <br />accomplished. at the Colowyo Mine [in compliance with Rule 2.R7.6(2)(b)].. . <br />III. Cumulative Impacts. The assessment ofthe probable cumulative impacts of all anticipated . <br />coal mining in the general area on the hydrologic balance, as described in Rule 2.05.6(3), has <br />been made by the Division. This assessment, entitled "Yampa River Cumulative Hydrologic <br />Impact Statement," is available for inspection at the offices of the Division. The Division fords <br />that the operations proposed under the Application have been designed to prevent material <br />damage to the hydrologic balance outside the proposed permit area [in compliance with Rule <br />2.07.6(2)(c)]. See Section B.
