Joe Dudash's November 17, 1992 inspection <br />report merely reiterated information which was provided to him by <br />workers at your residence during his inspection of your home. The <br />entire sentence from the inspection report is as follows: "They <br />reported that hairline cracks a year ago are now 1/2 inch wide." <br />You have requested that DMG identify all areas under your property <br />where either extraction or development mining has occurred, and the <br />dates of mining. This information is public information, as you <br />are aware, and is available for your or your agent's review and <br />copying at our office. <br />Response to June 26, 1995 letter: <br />During a telephone call on June 1, 1995 you indicated a belief that <br />Jim Pendleton had told either OSM or Basin that Basin was no longer <br />required to monitor subsidence impacts at your residence under the <br />written agreement you had with the them. You indicated that Mike <br />Rosenthal had told you that Pendleton had said this to him. You <br />later followed up with a fax to the same effect on June 27, 1995. <br />I believe the information to be hearsay and hardly worth pursuing. <br />However, in an effort to respond I asked Jim Pendleton if he <br />recalled such a conversation. Mike Rosenthal asked Jim Pendleton <br />whether DMG would enforce a written agreement between a mine <br />operator and a property owner. Pendleton responded to Rosenthal <br />that DMG has no jurisdiction to enforce any private agreements, we <br />C`~ <br />
