DEF I. Of teal <br />The inspection reports dated h'fay 12, 1981, and May 21, 1981, <br />request "An updated time schedule Yor backfilling all areas mined <br />but not reclaimed by May 31, 1981." Our operating plan Yor this <br />obligation was established in the late summer of 1980. At that <br />time, Energy Fuels and the Colorado Mined LanlReclamation Division <br />agreed that Energy Fuels Corporation would commit a minimum of <br />500 equipment hours per month to the reclamation of these areas. <br />Since that agreement, we have submitted a monthly written report, <br />acommpanied by photographs of the areas, recording the progress <br />and equipment hours expended. Over the past seven months, the <br />equipment hours reported to Mr. David Shelton were: <br />Dozers 5280.5 hours <br />Scrapers 3560.0 Hours <br />Blades 356.5 hours <br />9197,0 hours <br />To date, this program has resulted in an average of 1314 <br />equipment hours per month for filling, rough grading, and topsoiling <br />'in Area 1. These equipment hours do~not include the final grading <br />and seeding of the area and are 263 greater than the minimum hours <br />of the agreement. The results of this program have been commented <br />"- by your representatives on more than one occasion during inspections <br />and mine tours. <br />~l <br />Energy Fuels is willing to continue under the agreement described <br />above to backfill the following mined areas: Area 1, Area 2, and <br />Area 26. As You are aware, continued mining is planned for Areas 9, <br />10, and the portion of Area 2 south of the shop designated as an entry <br />to the Foiclel underground mine. 'therefore, the 500 hour per month <br />schedule does not apply to these areas. With respect to Areas 9 and <br />10, continued mining is under discussion between Energy Fuels <br />Corporation and Mined Land Reclamation Division. however, no final <br />decision has been reached concerning revision of the mine plan. Since <br />substantial coal reserves remain unmined in these areas, no backfilling <br />can occur until the mine plan is revised. <br /> <br />
