The lease was modified February 1, 1950, and then assigned to Thompson Creek <br />Coal and Coke Corp., a Colorado corporation, effective November 1, 1954. A transfer of the <br />lease through acquisition of Thompson Creek's assets in 1969/1970 was not approved by the <br />Bureau of Land Management (BLM), and Thompson Creek Coal and Coke Corp. remained the <br />lessee of record for federal coal lease D-037766. <br />In May 1989, the BLM Colorado State Office received two letters from Mr. Daniel W. Whalen, <br />Jr., Trust Department, Jefferson Bank & Trust. Mr. Whalen's letters raised serious questions <br />regarding the actual legal status of coal, lease D-037766..In August 1989, Mr. Whalen provided <br />this office with documentation that Thompson Creek_Coal and eoke:Corp,:had dissolved. • •. ~ :: _ • •~ <br />December 17, 1970, and that Mr. Albert M. Keenan, who had been President of the corporation, <br />had died on March 4, 1982. Mr. Whalen also requested remittance of refunds to the Keenan <br />Family Trust for payments under the lease since Mr. Keenan's death. <br />We have evaluated the information provided by Mr. Whalen in his initial and subsequent letters <br />as well as additional information provided by the solid minerals adjudication staff and by the <br />BLM Grand Junction District mining engineer.
