ti <br /> <br />-2- <br />The Division is unable to definitively assess the sealing of the <br />erosional depression on the basis of the inspections performed on <br />November 18 and December 3, 1992. Both the lineament around the sides <br />of the trench and the funnelling associated with the 3 1/2 gallon <br />infiltration experiment suggest that there were void spaces at various <br />points in time. The lineament around the trench may have been formed <br />from the original collapse. Lacking a percolation test for which <br />there is a control, or a vacuum test of some sort, or use of a great <br />volume of water in a well calibrated flow test, the Division is unable <br />to evaluate completely the integrity of the seal constructed in late <br />August, 1992. <br />Nevertheless, the Magpie Creek diversion still needs to carry water <br />against the south bank and the damage sustained during the culvert <br />installation and outfall washout has not been repaired. The April 22, <br />1992, Compliance Agreement also required Harrison Western to establish <br />a diversion channel by June 30, 1992.
