You must allow representatives from this office to inspect the authorized activity at any time deemed <br />necessary to ensure that it is being or has been accortq~lish ed in accordance with the terms and conditions of <br />your permit. <br />Soeci al Conditions: <br />1. The permittee shall maintain a minimum of a 150 foot buffer between the Colorado River and the <br />excavation boundary of the gravel pit at all times, <br />2. The permi ctee ui 11 maintain the gravel pit as deemed necessary by the Corps of Engineers to prevent the <br />pit from becoming the main channel of the Colorado River. <br />3. The permittee shall adhere to the Conservation Measures as outlined in the United States Fish and <br />wildlife Service's (Fw5) Biological Opinion number ES-GJ-6-CO-99-F-015. <br />4. The appropriate final design to allow the mining area to be restored as a floodplain feature as required <br />by the FwS in their Biological Opinion will ~be submitted to the Corps of Engineers for written concurrence <br />prior to construc ci on of the inlet and outlet structures. A written response from a certified hydrologist <br />addressing the concerns of Mr. Glenn A. Miller's letter to Ms. Sue Moyer of the FLIS dated May 20, 1999, <br />shall accompany the final design. <br />5. The revised mitigation plan titled Amended Appendix A of Envi ronmentaL Assessment Soaring Eagle Ranch <br />Cravel Pit, Amended July 1999, shall 6e implemented prior to mining phase V. <br />Further Information: <br />1. Congressional Authorities: You have been authorized to undertake the activity described above pursuant <br />co: <br />(x) Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403). <br />(x) Section 404 of the Clean water Act (33 U.S.C. 1344). <br />( ) Section 103 of [he Marine Protection, Research arcl Sanctuaries Act of 1972 (33 U.S.L. 1413). <br />2. Limits of this authorization. <br />a. This permit does not obviate the need to obtain other Federal, state, or local authorizations <br />required by law. <br />b. This permit does not grant any property rights or exclusive privileges. <br />c. This permit does not authorize any injury to the property or rights of others. <br />d. This permit does not authorize interference with any existing or proposed Federal projects. <br />3. Limits of Federal Liability. In issuing this permit, the Federal Goverrvnent does not assume any <br />Liability for the following: <br />a. Damages to the permitted project ar uses thereof as a result of other permitted or unpermitted <br />activities or from natural causes. <br />b, Damages to the permitted project or uses thereof as a result of current or future activities <br />undertaken by or on behalf of the United States in the public interest. <br />c. Damages to persons, property, or to other permitted or unpermitt ed activities or structures caused <br />6y Che activity authorized by this permit. <br />d. Design or construction deficiencies associated with the permitted work. <br />e. Damage claims associated with any future modification, suspension, or revocation of this permit. <br />
