-9- <br />The second survey, by Gordon and Kranzush, Inc. i.n 1980 and 1981, identified two <br />historic localities, five aboriginal isolated finds, as well as revisiting site <br />5 JA163. None of the newly recorded finds were recommended as eligible for nomin- <br />ation to the National Register of listoric Places. Gordon and Kranzush suggested a <br />complete reinvestigation of site 5 JA613 is needed to settle its eligibility <br />status and develop the mitigation plan if required. <br />Therefore, lcoated within the present boundaries of the Canadian Strip mine plan are <br />four sites, six localities and six isolated finds. Of the four sites, two have been <br />recommended as being eligible, 5 JAI63 and 5 JA411, with the <br />status of site 5 JA163 questionable. Two other sites, S JA40G and 5 JA93, lie <br />near, but outside, the mine seam boundaries. <br />Based on the original report information, a recommendation was made by OSM that <br />localities 5 JA409 and 5 JA913 and site 5 JA407 were not eligible to the National <br />Register. This recommendation was concurred with by the State Historic Preservation <br />Officer. Subsequently, the mine plan was revised with other previously and newly <br />recorded cultural resources falling within the revised mine plan area. A second <br />letter, recommending that Localities 5 JA912, 413, 914, 460, 486, 988 and isolated <br />finds 5 JA378, 380, 381, 487, 959 be considered as not meeting the criteria for <br />nomination to the NRHP, has been sent to the Colorado SHPO for his concurrence. <br />Additionally, the letter recommends that further work is required to determine the <br />eligibility of sites 5 JA163 and 5 JA411. <br />In order for the Division to make the finding required by Section 2.07.6(2)(e) that <br />the proposed mining operation will not adversely affect any public park or any place <br />listed on the National Register of Historic Places or eligible for such designation, <br />Wyoming Fuel Company must agree to the following stipulation: <br />THE ELIGIBILITY OF SEVERAL SITES, 5 JA913 AND 5 JA407, ARE IN QUESTION. OSM <br />INTENAS TO MAKE A FIELD CHECK OF THESE TWO SITES AND THEN 6fAKE RECOMMENDATIONS <br />TO THE SHPO AS TO THEIR ELIGIBILITY AND TREATMENT. UNTIL THE ELIGIBILITY <br />QUESTION ZS SETTLED, NO SURFACE DISTURBING ACTIVITIES MAY TAKE PLACE WITHIN <br />100 FEET OF THESE SITES. SHOULD ONE OR BOTH OF Tl7ESE RESOURCES BE DETERMINED <br />ELIGIBLE FOR LISTING ON THE NATIONAL REGISTER OF HISTORIC PLACES, THE APPLICANT <br />SHALL CONSULT WITH AND OBTAIN TFIE APPROVAL OF THE REGULATORY AUTHORITY AND <br />THE COLORADO SHPO CONCERNING THE DEVELOPPfENT AND IPIPLEMENTATION OF MITIGATION <br />MEASURES. ACTIVITIES SHALL NOT RESUME UNTIL THESE MEASURES HAVE BEEN <br />COMPLETED AND APPROVED. <br />With the acceptance of the above stipulation, the applicant will be in compliance <br />with aZl sections of 2.04.9, 2.05.6(4) and 2.07.6(2)(e) dealing with cultural and <br />historic resources and their preservation. <br />IV. Geology (2.04.5, 2.09.6(1)) <br />The applicant has provided both a general description of the regional geology and <br />a detailed analysis of the physical and chemical characteristics of all strata <br />disturbed at the site.
