SECTION B <br />The following findings and specific approvals are required by Rule 4. <br />Roads - Rule 4.03 <br />Haul Roads - No haul roads will remain on the permit area. <br />Access Roads <br />Alternative criteria and specifications were used during the <br />design of access roads. These criteria and specifications <br />are proposed for approval by the Division following an <br />analytical demonstration that the roads will be <br />environmentally sound and reclamation can be achieved. The <br />proposed criteria and specifications pertain to the access <br />road to Fruita No. 1 bench. All other roads on the permit <br />area have been reclaimed (4.03.2(1)(e)). <br />The landowner has requested the retention of the access road <br />depicted on Map No. 3. Its retention is compatible with the <br />approved post-mining land use. Therefore, the Division <br />proposes to approve retention of the access road <br />(4.03.2(1)(f)). <br />The Division proposes to approve of cut slopes steeper than <br />1V:1.SH or 1V:0.25H as a result of a geotechnical anal_asis <br />which demonstrated that a minimum safety factor of 1.5 can be <br />maintained or use of a lesser safety factor will not result <br />in significant environmental harm or harm to the public <br />health and safety. The cut slopes in question are located <br />along the access road to the Fruita txl Mine bench. <br />(4.03.2(3)(c>(i1). <br />II. Hydrologic Balance - Rule 4.05 <br />Water Quality Standards and Effluent Limitations <br />t4ost disturbed area drainage passes through the sediment pond <br />below the reclaimed a~~ea. Discharges from this pond are <br />monito~~ed to verify compliance with water quality standards <br />and effluent limitations (4.05.2(2)). <br />The Division has approved a small area exemption f; em use of <br />a sediment pond due to the limited size of the area and due <br />to the fact that ponds and treatment facilities are not <br />necessary for the drainage to meet the effluent limitations <br />of Rule 4.05.2 and applicable State and Federal water quality <br />standards for receiving streams and also due to the fact that <br />no mixing of surface drainage with a discharge from <br />underground workings will occur. The small area to be <br />exemoted is a 0.47-acre area where a sediment pond and <br />topsoil stockpile were previously located. A silt fence has <br />-a- <br />
