RECLAMATION BOND HISTORY <br />The original reclamation liability for the CCM No. 1 was $250,000.00. The Division previously <br />reduced the reclamation liability by $150,000.00 through approval of a Phase I bond release of the <br />entire disturbed area, which was approved in December of 1990. The Division further reduced the <br />reclamation liability through approval of a Phase II bond release request on Ianuary 19, 1997 from <br />$100,000.00 to the current liability amount of $38,000.00. This final Phase III bond release <br />application proposes the release of the remaining $38,000.00 in bond liability and termination of <br />jurisdiction in accordance with Rule 3.03.3(1). <br />PROCEDURES AND SUMMARY OF THE REVIEW <br />PROCESS <br />Kaiser applied for a Phase III bond release under the Colorado Surface Coal Mining Act <br />following the final two years of vegetation sampling. An application for a Phase III release was <br />received by the Division on September 17, 1999. Kaiser published notice of the bond release <br />application in the Huerfano World once weekly for four consecutive weeks beginning August 19, <br />1999. The application was found complete on September 27, 1999, after the Division received <br />proof of publication of the applicant's required public notice. Kaiser also notified landowners <br />adjacent to the mine permit area and other interested parties of the pending application for bond <br />release as required by Rule 3.03.2(1). <br />Reclaimed land north of county road <br />
