Proposed Decision <br />The Colorado Mined Land Reclamation Division is proposing 'to renew Cyprus <br />Empire's Eagle Mines complex permit with stipulations. <br />A findings document was developed by the Division for Permit Revision No. 1 on <br />April 24, 1987. This document incorporated all existing activities at the <br />site, recent revision and the permit revision into one concise document. For <br />permit renewal purposes this document was reviewed to ensure all existing <br />findings were valid. It was determined that a new finding<_; document was not <br />needed since none of the findings would be altered by issuance of the permit <br />renewal. <br />The following technical and minor revisions have been approved since approval <br />of Permit Revision 1: <br />MR-12 "Contractor Staging Area" approved September 28, 1987 <br />MR-13 "Access Road to Haul Road Certification" approved October 23, 1987 <br />TR-6 "Reclamation Plan - Williams Fork Strip Pit" approved June 22, 1987 <br />TR-7 "Livestock Ponds on Reclaimed Land" approved October 5, 1987 <br />TR-8 "Response to Stipulation 1, 2, 5, and 6" approved December 7, 1987 <br />TR-9 "Modify Hydrologic Monitoring" approved June 2, 1988 <br />Approval of these revision resulted in the reclamation bond increasing from <br />$3.058,995 to $3,092,105. The Division currently holds a bond in the amount <br />of $3,178,400. This bond is in the form of a corporate surety. No additional <br />bond is required by the permit renewal. Approval of these revisions did not <br />otherwise modify the April 24, 1987 findings documents. <br />Permit Revision No. 1 contained six stipulations. Since thfa approval of that <br />revision, Stipulations 1, 5, and 6 have been fully satisfied. <br />Stipulation 2 was also responded to but the response may require additional <br />Clairification so, at this time, it will be left as a requirement. The other <br />remaining stipulations are numbers 3 and 4. These stipulation are listed in <br />full below. <br />STIPULATION N0:2 <br />THE DIVISION DIRECTS EPiPIRE ENERGY CORPORATION TO SUBMIT TO THE DIVISION THE <br />RESULTS OF THE SAMPLING PROGRAM FOR ALL OVERBURDEN PROPOSED TO BE USED FOR <br />PLANT GROWTH MEDIA. <br />BASED UPON THE RESULTS OF THESE STUDIES, AND THE UTILIZATION OF ANY PROPOSED <br />SOIL AMENDMENTS, THE APPPLICANT SHALL DEMONSTRATE TO THE DIVISION'S <br />SATISFACTION THAT THE PROPOSED OVERBURDEN IS AN ACCEPTABLE PLANT GROWTH MEDIA. <br />a <br />
