using the water in the mining operation.
The water supply for the subirrigated azea near the Colorado River is, as previously
discussed, groundwater flow due to irrigation from the Vulcan ditch. Since CBM
has committed to not diverting excessive water for flood irrigation, the source of
water for subirrigating this area will not be affected.
The source of water for the subirrigated azea bisected by the Vulcan ditch is a small
ephemeral drainage. The proposed operation will not affect any of the azea tributary
to this drainage; therefore, there should be no effect on the water supply to this
subirrigated area.
3) The valley floor exists within the affected or adjacent area. The alluvial valley floors of the
Colorado River and Alkali Creek are located adjacent to but not on the disturbed area. The
Division finds that activities proposed by the applicant will:
not interrupt, discontinue, or preclude farming on the alluvial valley floors that aze irrigated or
naturally subirrigated [2.06.8(5)(a)(i) and 4.24.3(1)].
not materially damage the quantity or quality of water in the surface or ground water system
described above [4.24.3(3) and 2.06.8(5)(a)(ii)].
will comply with the requirements of the Act and the Regulations with respect to alluvial
valley floors [2.06.8(5)(a)(iii)].
XVIII. Operations on Prime Farmland
The Division has made a determination that there aze no prime farmlands within the proposed
permit area. The decision was based on evidence provided by the Soil Conservation Service
which appeazs on pages 3-171 to 3-173 in Volume I of the PAP. The Division makes no
approvals with regazd to such operations [2.06.6, 4.25.2(3), 4.25.4(2), and 4.25.5(2)].
XDt. Mountaintop Removal
There is no mountaintop removal at the site. Therefore, the Division makes no approvals with
regazd to such operations [2.06.3, 4.26.2].
XX. Operations on Steep Slopes
There aze no operations on steep slopes at the site. Therefore, the Division makes no
approvals with regard to such operations (2.06.4, 2.06.5, 4.27, 4.27.3, 4.27.3(6), 4.27.3(7),
4.27.3(8), 4.27.4(3), 4.27.4, and 4.27.5)].
27 June 1, 2006
