Mr. Carl Mount
Division of Minerals and Geology
July 14, 1995
Page 2
~~
Perplexing questions remain. Was Wayne Tatman truly entrusted
with the authority to commit COM, Inc. to a $5 million investment?
If so, and had he the commensurate power to terminate it (based,
ostensibly, on Mr. Hartley's alleged wrongdoing) then why was Mr.
Hartley entrusted within 24 hours after the termination with the
power to negotiate on behalf of COM by COM's owner, Gwen Fraser?
Apparently, the trust between COM and Durango/Hartley must have
been restored virtually overnight. The suit, of course, went on,
and was filed on the 20th.
One must also admire the speed of the Durango's legal
response. I know that lawyers work quickly, but I have never had an
investigation completed and a complaint drafted the same day that
a business tort occurred...I must just be getting slow.
I am sending herewith a copy of the December 15 termination
letter so that you may share my confusion. This was attached as
Exhibit D to the Complaint. Needless to say, I continue to
investigate the basis for this lawsuit, which seems to lead to more
and more confusing documents.
Very truly yours,
VR
By
JRH
Enclosure
cc: Charles Ruaa
