In developing the original permit and the PR #1 application, the applicant <br />consulted with the Colorado Division of Wildlife, the U.S. Fish and Wildlife <br />Service, and the Bureau of Land Management to develop appropriate mitigation <br />measures. The mitigation measures that were required included establishment of <br />shrub and tree clumps in the reclaimed areas, development of surface <br />undulations in reclaimed final grading to provide big game cover, special fence <br />and power line construction plans, special timing of construction activities and <br />wildlife monitoring (among other measures). Fish and wildlife habitat is a <br />planned post-mining land use. Seneca Coal Company has selected appropriate <br />plant species and distributions to benefit fish and wildlife (4.18(5)(1)). <br />The application contains commitments to obtain specific revision approvals from <br />the Division prior to any use of persistent pesticides or herbicides on the permit <br />area. The Division of Wildlife reviewed the PR #1 application, and their only <br />concern was in regard to the proposed reduction of the woody plant density <br />standard. Please see discussion in Section IX of this document. <br />In association with the Permit Renewal 02 review, both the Colorado Division of <br />Wildlife and the U.S. Fish and Wildlife Service were notified and their <br />comments concerning potential effects of the operation on threatened or <br />endangered wildlife species of wildlife were solicited. Neither agency indicated <br />concerns with respect to potential impacts to threatened or endangered species. <br />Pursuant to the finding required by Rule 2.07.6 (2) (n), and on the basis of <br />information set forth in the permit application and consultation with the <br />Colorado Division of Wildlife and the U.S. Fish and Wildlife Service, the <br />Division finds the proposed operation will not affect the continued existence of <br />endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitat. <br />XII. Operations on Alluvial Valley Floors <br />As part of PR #1, the applicant submitted adequate information for the Division <br />to make the required alluvial valley floor (AVF) determination and Findings in <br />accordance with Section 2.06.8 of the Regulations. Information on alluvial valley <br />floors is provided in Tabs 16 and 17 of the application. <br />AVF Determination <br />Seneca Coal Company conducted an extensive alluvial valley floor investigation <br />of the permit and adjacent area. This study included the use of aerial photos, <br />alluvial completion wells, stream gaging stations, and consultation with consulting <br />firms and Federal agencies. The study identified areas along Hubberson Gulch, <br />Dry Creek and Sage Creek which meet the criteria for designation as alluvial <br />valley floors (AVF).
