Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations a <br />permit renewal application for a valid existing permit to conduct surface coal mining <br />operations at the Seneca II-W Mine. <br />The application was submitted by Seneca Coal Company for the mine. This decision is <br />based on a finding that the operations will comply with all requirements of the Colorado <br />State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request <br />for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. Upon submittal of <br />acceptable surety by the applicant, the permit will be issued. The permit application, all <br />supporting documentation and any stipulations or conditions will become a binding part <br />of the permit. <br />Stipulations to Permit: <br />STIPULATION 23 <br />WITHIN 90 DAYS OF PERMIT RENEWAL 02 PROPOSED DECISION <br />ISSUANCE, THE PERMITTEE WILL SUBMIT A COMPLETE TECHNICAL <br />REVISION APPLICATION TO THE DIVISION WHICH EITHER: A) <br />MODIFIES THE TEXT ON PAGE 45, TAB 22 TO SPECIFY THAT THE <br />OVERALL MINE AREA WOODY PLANT DENSITY STANDARD IS 1000 <br />STEMS PER ACRE, OR; B) INCLUDES SUBSTANTIVE MODIFICATIONS <br />TO THE APPROVED RECLAMATION PLAN TO ENHANCE THE UTILITY <br />OF THE RECLAIMED LANDSCAPE FOR WILDLIFE, IF AN OVERALL <br />STANDARD OF LESS THAT 1000 STEMS PER ACRE IS PROPOSED. <br />2 <br />
