verified that the two ponds continue to be suitable for [he postmining land use (see Memo dated <br />x/20/99 in SL-03 file). Based on this recent verification, the Division finds that the current <br />demonstration supports the Iona-term utility of the ponds and confirms the two ponds meet [he <br />requirements of Section 4.0.9 for permanent impoundments. <br />V. CRITERIA FOR PHASE III RELEASE <br />Phase III is a final bond release. At Hayden Gulch, a Phase III bond release can occur: <br />1) No less than 10 years after the last year of augmented seeding, fertilizing, irrigation or <br />other work [Section 3.02.3(2)]; <br />2) When the permittee has successfully completed all surface coal mining reclamation <br />operations in accordance with the approved reclamation plan [Section 3.03.1(2)(c)]; <br />3) When all reclamation requirements of the Rules and the Act are fully met [Section <br />3.03.1(4)]; and <br />4) When the final inspection procedures of 3.03.2 have been satisfied [Section <br />3.03.1(2)(c)]. <br />Phase III bond release requirements remaining to be addressed in this findings document. The <br />Division has previously found that HGCC completed the following requirements for final bond <br />release as part of the Phase I and Phase II bond release requirements: <br />Phase I (approved in 1988 and 1991 <br />Removal of concrete <br />Removal of buildings and facilities <br />Backfilling of pit <br />Reduction of pit slopes <br />Regrading backfill and ponds (roads, ditches, culverts and two ponds aze permanent) <br />Reestablishment of drainage <br />Redistribution of topsoil <br />Phase II (discussed in this document in previous sections) <br />Revegetation of disturbed areas sufficiently to support postmining land use (final <br />bond release success criteria also were addressed) <br />Control of erosion and stabilization and/or repair of rills and gullies that form on <br />reclaimed lands <br />Hayden Gulch Mine Page 1 t May 25, 1999 <br />Phase II/III Bond Release <br />
