<br />APPLICATION' FOR AN <br />AMENDiv1ENT TO CONDITIONAL L'SE PER111[T -BRIGHTON MINE <br />NARRATIVE EXPLANATION <br />The sole purpose of thts application is to amend the exisung Conditional Use Permit For the Brighton <br />Mine to allow for 24-hour on-site transportation of material onto the E-470 right-of-way throughout the <br />constructton period of the E-470 protect, or for a period of two years from the date of approval of this <br />amendment application. The ongmal Condmonal Use Permit was approved by the Adams County Board <br />of County Commissioners on September 18. 2000, under Case No. PRJ2000-00036. <br />The hours of operation set forth in the ongmal Conditional Use Permit are 6:00 a.m. to 10:00 p.m. The <br />request to extend the hours of operation is a temporary operational change. This amendment application <br />does not otherwise materially affect the mining operation and reclamation plans as approved in Case No. <br />PRJ2000-00036. <br />The E-470 right-of--way lies south of and adjacent to the entire southern boundary of the Brighton Mine. <br />Aggregate Industries, formerly Imown as CAMAS Colorado, Inc., the operator of the Brighton Mine, has <br />contracted with the E-470 Project for the sale of fill material from the Brighton Mine for construction of <br />the highway. Fill material from the existing permitted mine area will be removed directly from the mine <br />site onto the E-470 right-of--way. <br />Haulage of this material will not occur upon or across any public streets or roads and will therefor neither <br />impact public streets and roads or traffic thereon. There are no residential structures within 1000 feet of <br />the North right-of--way of E-470, therefore the 24-hour on-site haulage of material is not expected to have <br />any impacts on surrounding property owners. <br />The temporary change in hours of operation is compatible with the sturounding azea, is not detrimental to <br />the immediate area, not detrimental to the future development of the azea, and not detrimental to the <br />health, safety, or welfare of the inhabitants of the area and the County. Aggregate Industries therefore <br />respectfully requests the favorable consideration and approval of this amendment. <br />
