PEABODY <br />,IIIIESTERN, <br />III III III IIIIIII III <br />` ~4°~ <br />Peabody Western Coal Company <br />June 15, 1993 <br />Ms. Susan Morrison <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />~?ECEI\/ED <br />JUN 18 1993 <br />Division o9 tv)6iera~s & Geology <br />RE: Annual Embankment Inspection - Seneca II Mine <br />Stipulation 5 to Permit No. C-80-005 <br />Dear Ms. Morrison: <br />Stipulation 5 to Permit No. C-80-005 is as follows: <br />"The embankment must be inspected annually, or within 10 days <br />following any storm whose backwater elevation exceeds the <br />elevation of 6941.1 feet above sea level (10-year, 24-hour <br />maximum storm event's projected backwater elevation), by a <br />qualified Geotechnical Engineer or Engineering Geologist. A <br />letter of certification containing the results of the inspection <br />must be submitted to the Division within two weeks following the <br />inspection." <br />In accordance with this stipulation, I, Thomas J. Wainwright, <br />Colorado P.E. 28482, inspected the subject embankment on June <br />l0, 1993 and do herewith submit my report of findings: <br />I. Chronology <br />A. July 14, 1981: F.M. Fox and Associates submitted a <br />report on their geotechnical slope stability <br />investigation of the embankment. The report concluded <br />that the embankment was stable with a minimum <br />static safety factor of 1.52. The report also <br />recommended revegetation and inspections. <br />B. September 23, 1981: Colorado Mining Permit No. C-80- <br />005 became effective. <br />C. Fall 1981: The embankment was hand seeded in <br />compliance with Stipulation 16 of Permit No. C-80-005. <br />D. June 15, 1982: The annual embankment inspection was <br />conducted. Weather conditions were favorable, skies <br />partly cloudy, temperature about 65° F.
