BASIC TERMS AND CONDITION -ALL FACILITIES (cont.) <br />otherwise provided by the Division, the permittce shall have 30 days after such.notification to both make the <br />necessary changes to the plan and to implement them. <br />The permittee shall amend the plan whenever there is a change in design, construction, operation, or <br />maintenance which has a significant effect on the potential for the dischazge of pollutants to the waters of the <br />State, or if the SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in <br />stormwater dischazges associated with mining activity. Amendments to the plan shall be summarized in the <br />Annual or Compliance Report. <br />Prohibition of Non-stormwater Dsscharges <br />a. Except as provided in pazagraph b, below, all discharges authorized by this permit shall be composed <br />entirely of stormwater. Dischazges of water other than stormwater must be addressed in a sepazate CDPS <br />permit issued far that dischazge. <br />b. Dischazges from the following sources that aze combined with stormwater dischazges associated with mining <br />activity may be authorized by [his permit, provided that the non-stormwater component of the dischazge is <br />identified in the SWMP (see Part I.B.4.g of [he permit): fire fighting activities, uncontaminated compressor <br />condensate, irrigation drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, <br />and foundation or footing drains where flows aze not contaminated. <br />4. Releases in Excess of Reaortable Quantities <br />This permit does not relieve the permittee of the reporting requirements of 40 CFR 110, 40 CFR 117 or 40 CFR <br />302. Any dischazge of hazazdous material must be handled in accordance with the Division's Notification <br />Requirements (see Part II.A.3 of the permit). <br />5. Facility Inspections <br />a. Active Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br />[heir stotmwa[er management system, at least twice per yeaz (in the spring and fall). Where semi-annual site <br />inspections aze shown in the plan to be impracticable because an employee is not stationed or does not routinely <br />visit the site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan, <br />but never less than once in two yeazs. These inspections must be documented and summazized in the Annual <br />Report (see Pan I.E.1 of the permit). , <br />b. Inactive Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection <br />of their stormwater management system, at least once per yeaz. Where annual inspections aze shown in the <br />plan to be impracticable, because an employee is not stationed at or does not routinely visit the site, an <br />inspection and certification is required once every three yeazs by a Registered Professional Engineer that the site <br />is in compliance with the plan. These inspections must be documented and summarized in the Compliance <br />Report (see Part I.E.1 of the permit). <br />c. Remediation Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br />their stormwater management system, at least once per yeaz (in the field season). Where annual site inspections <br />aze shown in the plan to be impracticable, because an employee is not stationed at or does not routinely visit the <br />site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan, but <br />never less than once in two yeazs. These inspections must be documented and summarized in the Annual <br />Report (see Part I.E.1 of the permit). <br />d. Inspection Requirements -ALL Operations. The inspections as required above must include the following: <br />1) Disturbed azeas and azeas used for material storage that aze exposed to precipitation shall be inspected for <br />evidence of, or the potential for, pollutants entering the drainage system.
