D. Sedimentation Ponds <br /> 1. Mountain Coal Company has constructed five sediment ponds and one <br /> freshwater pond (FW-1). The ponds have been designed, constructed and <br /> maintained in accordance with the requirements of 4.05.6 and 4.05.9. The <br /> location of these ponds can be found on Map 54. The designs of the ponds <br /> can be found in Exhibit 66. The ponds are located as near as practical to <br /> the disturbed area and are not located within perennial streams according to <br /> 4.05.6(1)(6). <br /> E. Acid-forming and Toxic-forming Spoil <br /> I . Underground development waste from underground workings at the West <br /> Elk Mine is handled as coal mine waste and placed on the Lower Refuse <br /> Disposal Area. No acid-forming or toxic-forming materials are present in <br /> the spoil in quantities significant enough to affect ground water quality. <br /> Therefore, special handling is not required for these materials (4.05.8(3)). <br /> F. Impoundments <br /> 1. Refer to the section regarding sediment ponds (4.05.9). <br /> G. Surface and Ground Water Monitoring <br /> 1. The applicant will conduct monitoring of ground water in a manner <br /> approved by the Division. The ground water monitoring plan is specified <br /> in Section 2.05.4, Ground Water Monitoring, and shown on Table 5, <br /> contained in Volume 1 of the permit document (4.05.13(1)). <br /> 2. The applicant will conduct monitoring of surface water in a manner <br /> approved by the Division. The monitoring plan is specified in <br /> Section 2.05.4, Surface Water Monitoring, and shown on Table 5 <br /> contained in Volume 1 of the permit document (4.05.13(2)). <br /> H. Transfer of Wells <br /> 1. No transfer of wells is proposed at this time. All monitoring wells will be <br /> reclaimed prior to bond release (4.05.14 (3)). <br /> I. Discharge of Water into an Underground Mine <br /> 1. There will not be any discharge of water into an underground mine <br /> (4.05.16(2)). <br /> J. Stream Buffer Zones <br /> 1. The Division proposes to approve underground mining activities within <br /> 100 feet of the North Fork of the Gunnison River, which is a perennial <br /> 23 <br />
