In this letter, I will try to comment on all of the necessary items from your packet. <br />Boundary Chanee <br />The cover letter stated that International Uranium (USA) Corporation ("IUC") proposes a change in the boundary <br />of this 112 permit. The Figure 3 map includes both original and proposed boundaries. It reveals that, as believed <br />by this office, though most of the present disturbance was inside the original boundaries, part of the dump <br />expansion on the east end does appear to have occurred outside the boundary. The map depicts the removal of a <br />large undisturbed area on the north side, and a corresponding additional area on the east and southwest, mainly to <br />include the waste dump, upland diversion structures, and dedicated access road. <br />The other two maps include Figure 1, which is another copy of the general location map showing complete <br />coverage of the five permitted sites in the Sunday mine group (this same map was submitted in February 2003 with <br />the proposed revisions of the Sunday Mine, M-1977-285); and Figure 2, which shows all the areas affected under <br />the West Sunday Mine permit. In general, I agree with the affected area delineations and proposed boundaries, <br />except for a couple areas detailed below. <br />The Figure 3 map includes an itemization of acreage for the various areas in the permit, with a total shown of 1 L86 <br />acres. Figure 2 shows each of the remote sites, and their respective affected areas delineated. You provided <br />reasons for including vent holes WS-l, WS-2, WS-3, and SJ-1, plus their attendant areas for power supply, <br />ventilation and access roads, which I agree with. But there are still a few areas which are not included, though I <br />believe they should be. Please explain why these features are not delineated or included in the acreage list: airline <br />holes 1 and 2, the nearby compressor building and water tank, and the electrical substations at WS-1 and WS-2. <br />Please be aware that IUC is approved for up to 20 acres of disturbance in this permit, and addition of these small <br />areas will result in a total acreage which is still-well below your approved limit. These items must be addressed <br />before any boundary change can be approved, and it would be better to include them all so that they may be <br />approved all at once. <br />Pending whatever additional information may be forthcoming in this matter, I do not view the boundary changes as <br />constituting a formal release of part of the permitted land, nor a formal addition of new land, for reasons explained <br />in the paragraphs below. <br />
