Begej <br />Mined Land Reclamation Div. <br />1313 Sherman St. <br />Denver, CO 80203 <br />Dear Ms. Begej: <br />~~~~~~~ <br />i pR 2 ? 199 <br />M/n@ <br />R~^la~„.d hand <br />^n i1, . <br />The Corley Company, 535 Southpointe Ct., Colorado Springs, CO 80906, hereby <br />requests a meeting with the Mined Land Reclamation Board pursuant to 1.14. <br />The Corley Company is the land owner of ~ Sec. 30, T20S, R69W of the 6th <br />P.14.; and is permittee C-81-045 for an area not related to the petition. <br />This petition relates to Rules 4.21 and 4.05.3(c). <br />Harrison Western drilled an exploratory drill hale in the above described <br />lands in about 1982. During the Apr. 23, 1992, Mr. Neslin, attorney for <br />Harrison Western, testified that Harrison Western did drill the hole. <br />According to the letter dated Mar. 13, 1992, from Daniel I. Hernandez, <br />Harrison Western did not have an exploratory permit for a drilling permit in <br />violation of Rule 4.21. Said drill hole was sealed by us in 1990, but the <br />drill hole site and road have not been reclaimed. Because the West Pit <br />boundary has been moved easterly, the drill hole is no longer within the new <br />Harrison 4lestern boundary. <br />In 1990 Harrison Western converted a diversion ditch into an access road <br />during one of their reclamation repairs in violation of Rule 4.05.3(c). This <br />ditch is also outside the new Harrison Western boundary. <br />We are petitioning the Board to determine Harrison Western's requirement to <br />reclaim the drill hole site and road and to restore the diversion ditch, and <br />to levy the appropriate penalties for these violations. <br />We estimate that our presentation will be ten minutes. <br />Sincerely, <br />W.D.
