I request that the project not be awarded to Mr. Lobato based <br />upon his failure to meet the condition in our bid specifications that makes <br />awards to the lowest responsive and responsible bidder. Mr. Lobato is a <br />principal in the firm of L & L Energy which had its permit to mine coal at this <br />project site revoked and its reclamation bond forfeited. As such, he is <br />blocked by federal and state regulations from receiving a permit to mine coal <br />anywhere in the country. His history of non-performance of requirements under <br />the Division of Minerals and Geology's regulatory program leads me to conclude <br />that he is not a "responsible" bidder. <br />To avoid similar situations in the future, the Division of Minerals and Geology <br />will be adding the following clarification of what constitutes a "responsible" <br />bidder to all new bid documents for reclamation work: <br />Responsible bidder - A company or individual who has had a Division of <br />Minerals and Geology permit revoked or bond forfeited or who has been <br />removed from a reclamation project for failure to perform will not be <br />considered a responsible bidder. ny or individual <br />unresolved problems n--or_f' 'al n ur <br />'th the Divisi a Considered a response idder; e <br />~m~-- - - <br />D' ion w~-~eva~uatefihese~~a~-Eer situations on-a~ case-by- bas <br />I hope this resolves both the current issue regarding the Blue F1 Project <br />and future similar si*_uati.ons.
