Mining Plan Approval Document No. CO-0021, September, 1985 <br />Page 1 of 3 <br />UNITED STATES <br />• <br />DEPARTMENT OF THE INTERIOR <br />This mining plan approval document is issued by the United States of America to <br />West Elk Coal Company <br />Box 591 <br />Somerset, Colorado <br />• <br />for the Mt. Gunnison No. I mine. West Elk Coal Company is hereinafter <br />referred to as the lessee/operator. <br />Section 1. Statutes and Regulations.--This mining plan approval is issued <br />pursuant to Federal coal lease C-1362; the Mineral Leasing Act <br />of 1920, as amended (30 U.S.C. 181 et sec.); and in the case of <br />acquired lands, the Mineral Leastng Act for Acquired Lands of <br />1947, as amended (30 U.S.C. 351 et sec.). This mining plan <br />approval is subject to all applicable regulations of the <br />Secretary of the Interior including, but not limited to, 30 CFR <br />Chapter VII and ~43 CFR Group 3400, and to all regulations of the <br />Secretary of Energy, which are now or hereafter in force; and <br />all such regulations are made a part hereof. The <br />lessee/operator shall comply with the provisions of the Water <br />Pollution Control Act (33 U.S.C. 1151 et sec.), the Clean Air <br />Act (42 U.S.C. 7401 et sec.) and other applicable Federal laws. <br />Section 2. This document approves the Mt. Gunnison No. 1 mine mining plan, <br />updated through September 12, 1985, and authorizes coal <br />development or mining operations on Federal lands within the <br />area of mining plan approval pursuant to a valid permit issued <br />by the Colorado Mined Land Reclamation Division (MLRD). This <br />authorization is rtot valid beyond the following portions of <br />T 135, R90W: <br />SE 1/4, S 1/2 NE 1/4, Section 19; <br />SW 1/2 NW 1/4, W 1/2 SE 1/4 NW 1/4, W 1/2 SW 1/4, <br />• <br />W 1/2 E 12 SW 1/4 Section 20; <br />N 1/2, N 1/2 S 1/2, Portion of S <br />Portion of N 1/2, Portion of SE <br />Portion NW 1/4, Portion of N 1/2 <br />29; <br />N 1/2 NE 1/4, Portion of SE 1/4 <br />Portion of NE 1/4 Section 34. <br />1/2 S 1/2 Section 27; <br />1/4 Section 28; <br />N 1/2 NE 1/4 Section <br />NE 1/4 Section 30; <br />Section 3. The lessee/operator shall conduct coal development and mining <br />operations only as described in the complete permit application <br />package as updated and approved by the Colorado Mined Land <br />Reclamation Division (MLRD), except as otherwise directed in the <br />conditions added to this mining plan approval. <br />
