The Colorado MLRD has reviewed WECC's PAP in accordance with the <br />approved State program and the cooperative agreement. In <br />coordination with Colorado MLRD's review, OSM reviewed the PAP, <br />including the operation and reclamation plan portion of the permit <br />• application, pursuant to the National Environmental Policy Act of <br />1969 (NEPA), the Surface Mining Control and Reclamation Act of 1977 <br />(SMCRA), the Federal Lands Program, and the cooperative agreement, <br />and provided its review comments to the Colorado MLRD. <br />The Colorado MLRD submitted on August 27, 1985, to OSM a decision <br />package containing the following: (1) its Proposed Decision and <br />Findings of Compliance for the State's approval with conditions of <br />the revision to State permit number C-007-80;(2) a chronology of <br />events relating to the processing of the PAP; and (3> the State's <br />permit document. The Proposed Decision and Findings of Compliance <br />was prepared by the Colorado MLRD in accordance with the cooperative <br />agreement to assist OSM in the preparation of this environmental <br />assessment in compliance with NEPA and the guidelines of the Council <br />on Environmental Quality. OSM has reviewed the Proposed Decision <br />and Findings of Compliance and agrees with the analysis and <br />conclusions except as discussed below; therefore, the Proposed <br />Decision and Findings of Compliance is incorporated as an integral <br />part of this environmental assessment. <br />2. Alternatives <br />Alternative 1, Approval Without Conditions--The Assistant Secretary <br />for Land and Minerals Management may approve the mining plan <br />modification in accordance with the recommendation of the Colorado <br />• MLRD. <br />Alternative 2, Disapproval--The Assistant Secretary for Land and <br />Minerals Management may disapprove the mining plan modification. <br />This alternative would have the same effect as taking no action. <br />Alternative 3, Approval With <br />Land and Minerals Management <br />modification with additional <br />attached to the State permit <br />of the mining plan approval <br />alternative. <br />Conditions--The Assistant Secretary for <br />may approve the mining plan <br />special Federal conditions beyond those <br />by Colorado MLRD and the requirements <br />document.
