~~. 1. The Office of Surface Mining (OSM) has reviewed the operation and <br />~• reclamation plan portion of the Mt. Gunnison No. 1 mine permit <br />revision application and determines that it complies with the <br />Surface Mining Control and Reclamation Act of 1977 (SMCRA), the <br />Federal Lands Program, and all other requirements of applicable <br />Federal laws. (See Environmental Assessment and Proposed Decision <br />and Findings of Compliance. <br />After reviewing the description of the proposed area of mining plan <br />modification approval, OSM determines this area is: <br />Not unsuitable for mining in accordance with section 522(b) <br />pursuant to section 522(a)(2) of SMCRA. (See Environmental <br />Assessment and the Proposed Decision and Findings of <br />Compliance. <br />b. Not unsuitable for mining in accordance with section 522(b) <br />pursuant to standards set forth in 522(a)C3) of SMCRA. <br />[See the Environmental Assessment.] <br />l• <br />Located on Federal lands within the boundaries of the <br />Gunnison National Forest. However, based on OSM's analysis <br />and on the concurrence of the Forest Service, the surface <br />operations and Impacts of the Mt. Gunnison No. 1 Mine are <br />incident to an underground coal mine and will not be <br />incompatible with significant recreational, timber, <br />economic, or other values of the Gunnison National Forest. <br />(See Environmental Assessment and U.
