<br />If you, on the other hand, feel enough reclamation has been done at <br />the site to meet the requirements for irrigated pasture, ie. the <br />post mining land use mentioned in the SCS reclamation plan or a <br />different post-mining land use more agreeable to you, then you, as <br />both land owner and permittee, may wish to change the approved <br />reclamation plan or post-mining land use to correspond with just <br />what has already been done at the site. If such a change amounts <br />to a significant change in the currently approved reclamation plan <br />or in post-mining land use, then this permit modification would <br />take the form of an amendment. If change of the reclamation plan <br />is not significant, then the permit modification could take the <br />form of a technical revision. There is no application fee for <br />either type of permit modification, but an amendment amounts to <br />applying for a new permit, ie. filling out the application form, <br />supplying any new information, referencing the old information <br />available in the current permit, providing all the public and other <br />notices that a new application requires. A technical revision, <br />however, is simply a request to modify the existing permit in a <br />minor way. Both require Division approval in order to be effected; <br />usually some adequacy concerns must be satisfied in order to secure <br />approval. <br />All this sounds rather complicated to me and I am familiar with the <br />process. I should think you would find it somewhat more difficult <br />to understand the various options described and would have some <br />additional questions after you have read this letter.
